ܽƵapp’s Commitment to Addressing Sexual Misconduct

ܽƵapp Community College (“ܽƵapp” or “the College”) is committed to maintaining a positive and safe learning and working environment. Title IX protects students, employees, applicants for admission and employment, and other persons from all forms of sex discrimination.

ܽƵapp students and employees are responsible for ensuring that the College remains an institution where all people can enjoy the benefits of the College’s educational activities free from sexual harassment. All members of the ܽƵapp community, including guests and visitors, are expected to conduct themselves in a manner that ensures a safe environment for all.

Pursuant to Title IX of the Education Amendments of 1972,

“No person in the United States shall, on the basis of sex*, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance . . . .” – 20 U.S.C. § 1681

ܽƵapp does not discriminate on the basis of sex* in the operation of all educational programs and activities. Under Title IX and 34 C.F.R. § 106.8, the College is prohibited from sex-based discrimination in both admission and employment activities as well.

This policy applies to all ܽƵapp students and employees, as well as applicants for admission and employment, and to all educational programs and activities conducted by the College, including admissions and employment. Further, all students and employees, as well as applicants for admission and employment, are protected from sexual harassment at ܽƵapp, regardless of whether it was committed by another College student, employee, or a third party. The College may also investigate allegations of sexual harassment, whether they occur on or off-campus.

Inquiries about the application of Title IX and related enforcement provisions and regulations may be referred to ܽƵapp’s Title IX Coordinator, the Assistant Secretary of the Office for Civil Rights of the U.S. Department of Education, or both.

Sexual Misconduct Prohibited

Sexual misconduct is conduct which violates College policy, including the Student Code of Conduct, and/or state or federal law. Upon receiving notice of sexual misconduct, the College will act to eliminate, prevent, and redress such misconduct. Sexual misconduct includes sex* discrimination, sexual harassment, sexual assault, rape, stalking, dating violence, domestic assault, and domestic violence.

Report

ܽƵapp encourages any person subject to sexual misconduct to report the conduct to law enforcement and to the College’s Title IX Coordinator:

Report a Crime

If there is a crime in progress or you need immediate medical care or safety measures, call 911. For non-emergencies, contact ܽƵapp Campus Safety & Security;

Anonymous Reporting

You may choose to file a report with ܽƵapp and request that your name not be used in the investigation process. However, it is often difficult to investigate allegations when an individual requests their name not be disclosed during an investigation. Reporting anonymously may limit the College’s ability to conduct a full investigation and take action. You may report anonymously through the page.

You may share a concern by filing a report using the . Filing a report is not the same as filing a formal complaint.

Contact a Responsible Employee

Responsible employees are all employees working for ܽƵapp. Employees have an obligation to report allegations of sex* discrimination or sexual misconduct. Responsible employees cannot keep your concerns confidential. If you take to these individuals, your concerns will be reported to the Title IX Coordinator for an investigation into your concerns.
